Are prenuptial agreements legally binding?

A prenuptial agreement is not automatically a legally binding document in England and Wales, and the court is not obliged to uphold the document.

In most circumstances, however, a prenuptial agreement will be taken into consideration by the court, but usually only where the document was drafted by a qualified lawyer, and certain conditions were met by the involved parties.

Examples of the required conditions include:

  • Both parties entered into the agreement freely and voluntarily
  • Both parties are aware of and understand the potential implications of the agreement
  • Both parties have fully provided their financial information
  • The prenuptial agreement is fair to both parties

What should be included in a prenuptial agreement?
