Prenuptial agreement FAQs

Are prenuptial agreements legally binding?

A prenuptial agreement is not automatically a legally binding document in England and Wales, and the court is not obliged to uphold the document.

In most circumstances, however, a prenuptial agreement will be taken into consideration by the court, but usually only where the document was drafted by a qualified lawyer, and certain conditions were met by the involved parties.

Examples of the required conditions include:

  • Independent legal advice was sought by each party
  • Both parties entered into the agreement freely and voluntarily
  • Both parties are aware of and understand the potential implications of the agreement
  • Both parties have fully provided their financial information
  • The prenuptial agreement is fair to both parties
  • The prenuptial agreement does not adversely affect any children

What should be included in a prenuptial agreement?

Examples of what should be included in a prenuptial agreement include:

  • Property the couple owns individually and/or jointly and how it would be divided in a divorce
  • Savings
  • Investments
  • Existing and potential future debts
  • What would happen to children e.g. where their permanent residence will be and the amount of contact each parent will have

You will not be able to obtain a prenuptial agreement after marriage as ‘pre’ means before marriage. However, you will be able to obtain a postnuptial agreement which offers the exact same protection and can be made once you are married.
