Prenuptial agreement FAQs

Are prenuptial agreements legally binding?

A prenuptial agreement is not automatically a legally binding document in England and Wales, and the court is not obliged to uphold the document.

In most circumstances, however, a prenuptial agreement will be taken into consideration by the court, but usually only where the document was drafted by a qualified lawyer, and certain conditions were met by the involved parties.

Examples of the required conditions include:

  • Independent legal advice was sought by each party
  • Both parties entered into the agreement freely and voluntarily
  • Both parties are aware of and understand the potential implications of the agreement
  • Both parties have fully provided their financial information
  • The prenuptial agreement is fair to both parties
  • The prenuptial agreement does not adversely affect any children

What should be included in a prenuptial agreement?

Examples of what should be included in a prenuptial agreement include:

  • Property the couple owns individually and/or jointly and how it would be divided in a divorce
  • Savings
  • Investments
  • Existing and potential future debts
  • What would happen to children e.g. where their permanent residence will be and the amount of contact each parent will have
  • Inheritance

Your personal circumstances may be more complex and mean that other matters should be included in your prenuptial agreement. Our solicitor can help advise you on what you should include.

Who should get a prenuptial agreement?

We would recommend anyone who is contemplating marriage to obtain a prenuptial agreement but particularly in situations such as:

  • You have children from a previous marriage
  • You want to protect your assets
  • You own a business and want to remain in control
  • You have, or may receive an inheritance
  • You have assets that are difficult to divide
  • Your partner has debts
  • You have a high net worth
  • There is the possibility of an international divorce

Can I get a prenuptial agreement after marriage?

You will not be able to obtain a prenuptial agreement after marriage as ‘pre’ means before marriage. However, you will be able to obtain a postnuptial agreement which offers the exact same protection and can be made once you are married.
